Durable (financial) Power of Attorney

 A Durable Power of Attorney (DPOA) is a legal document that authorizes someone you choose (your "agent" or "attorney-in-fact") to manage your financial affairs if you become incapacitated.  These are essential to pair with a Trust or a Will.  "Durable" means the power remains in effect even if you become mentally incompetent.   A POA can cover a wide range of financial matters, including:  

  • Paying bills
  • Managing bank accounts
  • Investing money
  • Selling property
  • Filing taxes

A Health Care Power of Attorney (HCPOA) is a legal document that designates someone you trust to make medical decisions for you if you become unable to communicate your wishes.  This person (your "agent" or "proxy") will have the authority to:

  • Choose doctors and hospitals
  • Access your medical records

  HIPAA (Health Insurance Portability and Accountability Act) Release form authorizes the release of your protected health information to specific individuals you designate.  This allows your chosen representatives, such as your Health Care Power of Attorney agent, to access your medical records and communicate with your healthcare providers.  Without a HIPAA Release, even your closest family members may be denied access to your health information.
